Introduction

These Terms of Service ("Terms") govern your access to and use of Safety Pro, a workplace environmental, health and safety (EHS) management platform operated by Barabbas Tech (Pty) Ltd, a company registered in the Republic of South Africa ("Safety Pro", "we", "us" or "our"). By creating an account, accepting an invitation to join an organisation, or otherwise using Safety Pro, you agree to be bound by these Terms together with our Privacy Policy.

Service description

Safety Pro is a software-as-a-service platform that enables organisations to manage workplace safety records, including sites, risk assessments and method statements, incident reports, permits to work, inspections, training attendance and competency records, toolbox talks, daily safe task instructions, personal protective equipment issuances, and related safety file documentation. Safety Pro includes an AI-assisted drafting feature for risk assessments and method statements.

Account eligibility and responsibility

You must be at least sixteen years old to use Safety Pro. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your credentials, and for any activity that occurs under your account. If you use Safety Pro on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.

Acceptable use

You agree not to reverse engineer, decompile or disassemble Safety Pro; not to attempt to gain unauthorised access to any part of the service; not to abuse the AI-assisted features to generate unlawful, defamatory or infringing content; not to misuse the personal information of colleagues that you may access as part of your role; not to introduce malicious code; and not to use Safety Pro in any manner that violates applicable law or the rights of any third party.

Subscriptions, billing and refunds

Subscription fees are billed through Payfast in South African Rand. Pricing, billing cycle and plan features are as displayed at the time of purchase. Card payments are captured directly on Payfast's secure, PCI-DSS Level 1 compliant hosted payment page; Safety Pro does not collect or store your full card details, and we do not apply any surcharge for paying by card. Unless required by law, subscription fees are non-refundable. You may cancel your subscription at any time from within the application; cancellation takes effect at the end of the current billing cycle.

Intellectual property

Safety Pro, including all software, designs, logos, documentation and AI prompts, is owned by Barabbas Tech and is protected by copyright and other intellectual property laws. You retain ownership of the content and data that you upload or create within Safety Pro. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process and display that content solely to the extent necessary to operate the service for you.

User content and data controller relationship

Your organisation is the data controller (responsible party under POPIA) of the workplace safety records created in its Safety Pro tenant. Barabbas Tech acts as a processor (operator) on behalf of your organisation under the terms of the applicable subscription agreement and this Privacy Policy. You are responsible for the accuracy and lawfulness of the content you upload.

Professional responsibility and AI-assisted features

Safety Pro is a software tool designed to ease, organise and streamline workplace health and safety administration. It is not a health and safety consultancy, it does not provide professional safety advice, and it is not a replacement for the engagement of a qualified health and safety expert. Safety Pro is intended to be used by, or under the supervision of, a competent health and safety practitioner. It supplements, and must never replace, appropriate professional expertise, training and on-site judgement.

The AI-assisted features generate draft risk assessments, method statements and related content using third-party predictive language models. This output may be incomplete, inaccurate, outdated or unsuitable for your specific site, task or jurisdiction, and it does not represent the views of Safety Pro or of the underlying AI provider. All AI-generated output is a starting draft only. A competent person must review, verify, adapt and formally approve every risk assessment, method statement and other safety document before it is communicated, relied upon or put into operational use. You must not rely on AI-generated output without independent human review.

You and your organisation remain solely responsible for the accuracy, adequacy and legal compliance of your workplace safety arrangements, including compliance with the Occupational Health and Safety Act, 1993, its regulations, and any other applicable law or standard. Nothing produced by or through Safety Pro guarantees compliance with any law, regulation or standard, or the safety of any workplace, task or person.

Warranties and disclaimers

Safety Pro is a software tool to help you manage workplace safety records. As set out above, it is not a substitute for qualified professional safety advice or for a competent health and safety expert, and it does not guarantee compliance with any particular law, regulation or standard. To the maximum extent permitted by law, Safety Pro is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of liability

To the maximum extent permitted by law, Barabbas Tech and its affiliates will not be liable for any indirect, incidental, consequential, special or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or in connection with your use of Safety Pro. Our aggregate liability arising out of or in connection with the service and these Terms will not exceed the amount paid by you to Barabbas Tech in the twelve months immediately preceding the event giving rise to the claim.

Indemnification

You agree to indemnify and hold Barabbas Tech harmless from and against any claim, loss, liability or expense (including reasonable legal fees) arising out of your breach of these Terms, your violation of applicable law, or your infringement of the rights of a third party.

Termination

Either party may terminate these Terms by cancelling the subscription as permitted by the applicable plan. We may suspend or terminate your access immediately if you materially breach these Terms, if continued access poses a security risk, or if required by law. On termination, your right to access the service ends and we will retain or delete your information in accordance with the Privacy Policy.

Governing law

These Terms are governed by the laws of the Republic of South Africa. You consent to the non-exclusive jurisdiction of the South African courts in respect of any dispute arising out of or in connection with these Terms, without prejudice to your rights as a consumer under applicable consumer protection law.

Dispute resolution

Before commencing formal proceedings, the parties will attempt in good faith to resolve any dispute by negotiation. If the dispute cannot be resolved within thirty days, either party may refer the dispute to arbitration under the rules of the Arbitration Foundation of Southern Africa, or to the competent South African courts.

Changes to these Terms

We may update these Terms from time to time. When we make an update, we will notify you within the Safety Pro application and provide a link to the revised Terms so that you can review them in full before deciding whether to continue. We will require you to accept the updated Terms before you continue to use Safety Pro. The "Effective date" shown below always reflects the current version, and your acceptance is recorded against the version in force at the time you accept.
